Why the constellation capricornus is sign of the zodiac while ursa major is not?

In order for a constellation to be considered a zodiac it must be within 8 degrees of the Sun's ecliptic.Since Ursa Major is at +55.38掳 declination, it is not within 8 degrees of the ecliptic.

Capricornus falls at a declination of -22 degrees, which is within the ecliptic. http://en.wikipedia.org/wiki/Capricornus

Western zodiacs are as observed in the "apparent" path of the earth, not the real path.Why the constellation capricornus is sign of the zodiac while ursa major is not?Ursa Major is a circumpolar constellation, i.e. it never rises or sets in the northern hemisphere (and never seen in the southern hemisphere).

The Zodiac constellations and signs go around the central band of the sky from tropic to tropic and crossing the equator.

So Ursa Major isn't a Zodiac constellation.
